These Terms govern your access to and use of InstaIncognito.

1) Agreement to Terms

These Terms of Use (“Terms”) govern your access to and use of InstaIncognito (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms from time to time. When we do, we will change the “Last updated” date below and, where required by law, provide additional notice. Your continued use of the Service constitutes acceptance of the updated Terms.

InstaIncognito is an independent website/tool. We are not affiliated with, endorsed by, or sponsored by Instagram™ or Meta Platforms, Inc. Instagram™ and Meta™ are trademarks of their respective owners.

You must be able to form a binding contract under applicable law. If you are under the age where you can legally consent to online services in your country, you may only use the Service with the consent of a parent/guardian. You are responsible for ensuring the Service is lawful where you use it.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, lawful purposes. All third-party content remains the property of its owners.

When you submit URLs or other User Content, you represent that you have the necessary rights to do so. The Service may display or link to third-party sites and content (including Instagram). We are not responsible for third-party sites, their content, policies, or availability.

We respond to valid intellectual-property notices. If you believe content accessible through the Service infringes your rights, email support@instaincognito.com with: (a) your contact details; (b) a description of the work you believe is infringed; (c) the exact URL(s) at issue; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act; and (f) your physical or electronic signature.

See our Privacy Policy for how we process limited data (e.g., basic logs, contact form submissions). We do not ask for your Instagram password.

12) Availability; Changes; Suspension

We may modify, suspend, or discontinue the Service (or any feature) at any time, without liability. We may block or limit access if we believe you have breached these Terms or to protect the Service or others.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT). WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THIRD-PARTY CONTENT WILL REMAIN AVAILABLE.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. TO THE EXTENT NOT EXCLUDED, OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF EUR 50 OR THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain disclaimers/limits; in those places our liability is limited to the maximum extent permitted by law.

You will defend, indemnify, and hold harmless InstaIncognito and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your breach of these Terms.

Governing law & disputes

If you are using the Service as a business (not a consumer), these Terms and any non-contractual obligations are governed by the laws of Romania, excluding its conflict-of-law rules. The courts located in Bucharest, Romania shall have exclusive jurisdiction, and you consent to their personal jurisdiction and venue.

If you are a consumer resident in the EEA, UK, or Switzerland, you will benefit from any mandatory provisions of the law of your country of residence. You may bring proceedings in your local courts or in the courts of Bucharest, Romania. Nothing in these Terms limits your mandatory consumer rights.

In all cases, the United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

17) Export & sanctions

You represent that you are not subject to embargoes or on any sanctions list that would prohibit you from using the Service. You agree to comply with applicable export control and sanctions laws.

18) Children

The Service is not intended for children under the age required to consent to online services in their country. Do not use the Service if you are under that age.

19) Electronic communications; Notices

By using the Service, you consent to receiving communications electronically. Legal notices to us must be sent to contact@instaincognito.com.
